Terms and Conditions

1. Scope

These Terms and Conditions ("Terms") govern the use of the "Granny-AI" mobile application and website between Granny-AI, a product of Binoron, LLC, 1111B S Governors Ave # 47095, Dover, DE 19904, United States ("Provider") and the user ("User").

2. Services

2.1 Features

  • AI Generation: Personalized stories, letters, poems
  • Family Profiles: Management of family members and pets
  • Memory Games: Brain fitness games
  • Memories: Memoir function for personal life stories

2.2 Availability

The app is provided "as is". No guarantee for uninterrupted availability. Maintenance will be announced when possible.

3. User Obligations

  • Minimum Age: 18 years
  • Authentication: Secure storage of login credentials
  • Prohibited Content: No illegal, offensive, or copyright-infringing content
  • Abuse Prevention: No manipulation of AI for harmful purposes

4. Rights to Generated Content

  • Copyright: Users receive non-exclusive usage rights to generated stories
  • AI Generation: Content is created by AI, no guarantee of uniqueness
  • Uploaded Photos: Users guarantee they own the rights to uploaded images

5. Subscriptions and Payments

5.1 Subscription Models

Try free for 14 days with usage limits and no credit card. Further AI use then requires a paid subscription. The trial does not automatically start a paid subscription.

Standard: EUR 4.99/month or EUR 49.99/year. Premium: EUR 9.99/month or EUR 99.99/year. Both plans have usage limits. Web subscriptions are purchased and managed through Stripe.

5.2 Automatic Renewal

Important notes on automatic renewal:

  • Automatic renewal: All subscriptions renew automatically unless canceled at least 24 hours before expiration
  • Billing (Web/PWA): Charges are processed by Stripe (Stripe Payments Europe Ltd. / Stripe, Inc.). We never see or store your full card details.
  • Billing (Mobile in-app): Charges occur via your Apple App Store or Google Play Store account
  • Price changes: You will be notified 24 hours before any price change
  • Renewal timing: Renewal is charged within 24 hours before the current period expires

5.3 Cancellation & Management

How to manage or cancel your subscription:

Web / PWA (Stripe):

  1. Sign in to your account
  2. Go to Account Settings → Billing
  3. Open the Stripe Customer Portal
  4. Update payment method, cancel, or change plan at any time

iOS (iPhone/iPad):

  1. Open the Settings app
  2. Tap your name at the top
  3. Select Subscriptions
  4. Select Granny-AI
  5. Tap Cancel Subscription

Android:

  1. Open the Google Play Store app
  2. Tap your profile icon
  3. Select Payments & subscriptions → Subscriptions
  4. Select Granny-AI
  5. Tap Cancel subscription

Important: Mobile in-app subscriptions can only be canceled through the respective store. Web/PWA subscriptions are managed exclusively via the Stripe Customer Portal.

After cancellation:

  • Your subscription remains active until the end of the paid period
  • You retain access to all Premium features until the expiration date
  • Your data remains preserved
  • In case of a new subscription, your data will be restored

5.4 Payment Processing

Important for your security:

  • Web / PWA: Payments processed by Stripe (Stripe Payments Europe Ltd. / Stripe, Inc.). Subscription management via the Stripe Customer Portal linked from your account settings.
  • Mobile in-app purchases: Processed via Apple App Store (iOS) or Google Play Store (Android), managed via RevenueCat
  • Granny-AI does not store credit card data, bank details, or full payment information
  • Your payment data is processed exclusively by Stripe or Apple/Google
  • We only receive confirmation of successful purchase (without payment details)

6. Right of Withdrawal (Consumer Rights)

6.1 Consumer Rights

In accordance with the Consumer Protection Law, 5741-1981, you have the right to cancel a transaction within 14 days of the agreement, subject to the following exceptions:

  • Digital content that has been accessed or downloaded cannot be returned
  • Cancellation of subscriptions is possible at any time through Stripe for web subscriptions or the App Store/Play Store for mobile subscriptions

6.2 EU Consumers

EU consumers have a 14-day right of withdrawal under the EU Consumer Rights Directive (2011/83/EU). By starting to use the digital content during the withdrawal period, you acknowledge and agree that:

  • You expressly consent to the immediate provision of digital content
  • You acknowledge that you lose your right of withdrawal once the digital content is fully provided
  • For subscriptions, cancellation is possible at any time via the respective store (see section 5.3)

7. Account Deletion

7.1 User Deletion

You can completely delete your account at any time:

In the app:

  1. Go to Settings
  2. Scroll down to Account
  3. Tap "Delete Account"
  4. Confirm deletion

What will be deleted:

  • All profile information
  • All created content (stories, memories, letters)
  • All game progress
  • Account login credentials

What remains preserved:

  • Subscription transaction data (7 years, legal and tax compliance)
  • Anonymized analytics data (no personal association possible)

Important: Deletion is final and cannot be reversed!

Note on subscriptions: Account deletion does NOT automatically cancel your subscription. Cancel your subscription separately through Stripe for web subscriptions or App Store/Play Store for mobile subscriptions (see section 5.3).

8.1 Warranty Disclaimer

  • No guarantee for accuracy or completeness of AI-generated content
  • No liability for emotional reactions to generated stories
  • AI-generated content should not be used as a substitute for professional medical, legal, or financial advice

8.2 Limitation of Liability

  • Liability only for intent and gross negligence
  • No liability for indirect damages or data loss due to user error
  • AI Services: No liability for OpenAI/Google service outages
  • This limitation does not apply to the extent prohibited by mandatory consumer protection laws in your jurisdiction

9. Technical Requirements

  • iOS: 13.0 or higher (for Apple Store)
  • Android: API Level 34+ / Android 14+ (for Google Play)
  • Internet: Active internet connection required for AI features
  • Offline Mode: Limited features available

10. Changes to Terms

The Provider reserves the right to modify these Terms. Users will be notified at least 14 days before changes take effect via email and/or in-app notification. Continued use of the app after the effective date constitutes acceptance of the updated Terms. If you do not agree to the changes, you may terminate your account before the effective date.

11. Governing Law and Jurisdiction

  • Governing Law: These Terms are governed by the laws of the State of Delaware, United States
  • Jurisdiction: Any disputes shall be subject to the competent courts in Delaware, United States, unless mandatory consumer law provides otherwise
  • EU Consumer Protection: For EU consumers, mandatory consumer protection regulations of your country of residence apply additionally. You also have the right to bring proceedings in the courts of your country of residence
  • US Consumer Protection: For US consumers, applicable federal and state consumer protection laws apply additionally

12. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that comes closest to the economic purpose of the invalid provision.
